Terms of Service

1. Acceptance of Terms

By accessing and using Svarwise ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Svarwise provides AI-powered review response management software that helps businesses respond to customer reviews across multiple platforms. The Service includes:

  • AI-generated review responses
  • Sentiment analysis
  • Google Business Profile integration
  • Multi-language support
  • Brand voice customization
  • Safety guardrails and moderation

3. User Accounts

3.1 Account Creation

You must create an account to use the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old and have the authority to enter into this agreement. By creating an account, you represent that you meet these requirements.

4. Free Trial and Subscription

4.1 Free Trial

New users receive a 10-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.

4.2 Subscription Plans

Subscription fees are billed monthly or annually in advance. By subscribing, you agree to:

  • Pay all fees associated with your chosen plan
  • Automatic renewal unless cancelled
  • Price changes with 30 days notice
  • No refunds for partial months (except as required by law)

4.3 Cancellation

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. You will retain access to the Service until that time.

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to harass, abuse, or harm others
  • Generate fake or misleading reviews
  • Resell or redistribute the Service without permission
  • Reverse engineer or attempt to extract source code

6. AI-Generated Content

6.1 Review and Approval

All AI-generated responses are drafts requiring your review and approval before posting. You are solely responsible for any content you post using the Service.

6.2 Content Accuracy

While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You must review all content before use. Svarwise is not liable for any damages resulting from AI-generated content.

6.3 Content Ownership

You retain all rights to content you create or post using the Service. By using the Service, you grant us a license to process your content to provide the Service.

7. Intellectual Property

The Service, including all software, designs, text, graphics, and other content, is owned by Svarwise and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Third-Party Services

The Service integrates with third-party platforms (Google Business Profile, payment processors, etc.). Your use of these integrations is subject to their respective terms of service. We are not responsible for:

  • Third-party service availability or reliability
  • Changes to third-party APIs or services
  • Third-party data practices or security
  • Disputes between you and third-party providers

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SVARWISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Svarwise from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Non-payment of fees
  • Fraudulent or illegal activity
  • Abuse of the Service or our staff
  • At our discretion with 30 days notice

Upon termination, your access to the Service will cease, and we may delete your data after 30 days (except as required by law).

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use after changes constitutes acceptance of the new Terms.

14. Governing Law
